Document Description
The Department of Cannabis Control, pursuant to authority granted under Business and Professions Code, Division 10, Chapter 2, Section 26012, approved a Small Outdoor commercial cannabis licenses. The project is an existing cannabis cultivation site located at 791 BARKER VALLEY RD HAYFORK, CA 96041 (APN 017-440-003-000). The project includes the cultivation of up to 10,000 square feet (SF) of outdoor mature canopy. The applicant currently holds a Small Outdoor Cannabis Cultivation License from the County (CCL-571) and an Adult-Use Small Outdoor Cannabis Cultivation License from the Department of Cannabis Control (CCL19-0004796, expires 2025-02-07), which will be surrendered upon approval of the new license. Cultivation activities include approximately 10,000 SF of outdoor canopy area consisting of (174) 5'x5' raised boxes for mature canopy and a 16'x32' hoop house for immature canopy. Supporting infrastructure includes: an 8'x40' metal container for agricultural chemical storage (8'x20') and processing area that will transition to harvest storage (8'x20'); a 10'x10' cannabis waste area for composting; two (2) trash holding structures constructed of wire fencing; ten (10) 2,500-gallon and four (4) 5,000-gallon water storage tanks; and four(4) 275-gallon nutrient mixing tank. Water for this project will be through a permitted well, a permitted septic will serve as the project's wastewater needs, and the project is connected to Trinity PUD electrical grid for the project's energy needs. Reasons for Exemption
The Department of Cannabis Control has determined that the project is a Class 1 Categorical Exemption Project. Class 1 Categorical Exemptions consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alterations to existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. The Project involves the use of an existing building with no proposal for expansion. The design, location, size, and operating characteristics of the Project are compatible with the existing and future land uses within the vicinity as it is zoned for light industrial.

Reasons for Exemption
The Department of Cannabis Control has determined that the project is consistent with the local jurisdiction community plan and/or zoning designations. CEQA mandates that the project is consistent with the development density established by existing zoning, community plan, or general plan policies for which an EIR was certified and shall not require additional environmental review, except as might be necessary to examine whether there are project-specific significant effects which are peculiar to the project or its site. The project activity fits within the parameters included in CEQA Guidelines Section 15183 and the activity does not require additional CEQA analysis.
