The issuance of the Certificate of Exemption was a ministerial act in accordance with Air District regulatory criteria for ministerial projects; therefore, Argent Material, Inc.’s exemption application was not subject to the environmental review requirements of CEQA. The Bay Area Air Quality Management District has verified that Argent Materials, Inc.’s operation of the storage piles and paved haul roads meets the objective, fixed standards for an exemption as set forth in Air District Regulations 2-1-115.1.4.5, 2-1-115.1.5, and 2 1 128.19.
