Reasons for Exemption
City staff has analyzed the project’s potential effects on the environment and has determined that the project is categorically exempt from the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines Section 15301 (“Existing Facilities”) and that none of the exceptions to the categorical exemptions contained in CEQA Guidelines Section 15300.2 are applicable to the project. Section 15301 of the California Environmental Quality Act (CEQA) Guidelines, titled “Existing Facilities,” reads as follows: “Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. […] The key consideration is whether the project involves negligible or no expansion of an existing use.” The construction of a 900-square-foot detached shade structure, a 285-square-foot attached restroom, and a 380-square-foot attached storage room located on a vacant portion of an existing religious facility site, constitute the minor alteration of an existing private facility, involving negligible expansion of the existing land use. Therefore, the project is exempt from CEQA pursuant to Section 15301 of the State CEQA Guidelines.
