Reasons for Exemption
This project is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. It can be seen with certainty that there is no possibility that this project may have a significant effect on the environment; therefore, the activity is not subject to CEQA. [Reference: State CEQA Guidelines sec. 15061(b)(3), General Rule Exemption]. To supplement this exemption, the applicant submitted a Biological Resources Assessment (BRA) that analyzed the project site for sensitive and protected biological resources. The biologist concluded that the project would occur on mostly developed land. Potentially suitable habitat for vernal pool fairy shrimp and western spadefoot toad was identified adjacent to the project area; however, the project will not overlap on these potentially suitable habitat locations. The recommended avoidance measures listed by the biologist have been implemented as conditions of approval. These include work timing, work limits, and a designated equipment staging area. Additionally, a pre-activity nest bird survey is recommended if work is planned to occur between February 1 and August 31 to ensure avoidance as the biological field survey observed red-shouldered hawk nestlings on-site along with identifying the property as suitable habitat for prairie falcon and the tricolored blackbird.
