Document Description
A request for a RIGHT-OF-WAY VACATION to vacate a 4,749-square-foot (0.11-acre) unimproved 80-foot-wide portion of E Street between 29th Street and 30th Street. The project also proposes public improvements, including a 35-foot radius cul-de-sac, curb, gutter, storm drain, and sidewalk at the terminus of E Street. On May 12, 2009, City Council approved the vacation of E Street per Resolution Number R-304895. However, the permit expired and updated right-of-way easement dedication documentation is required. The project site is designated Residential and zoned RM-2-5 per the Greater Golden Hill Community Plan. The project site is also within the Airport Land Use Compatibility Noise Contours (San Diego International Airport), the Airport Influence Area (San Diego International Airport – Review Area 1), the Federal Aviation Administration Part 77 Noticing Area, the Airports Noise Contours (San Diego International Airport – 60 to 65 CNEL), the Residential Tandem Parking Overlay Zone, the Transit Area Overlay Zone, and the Transit Priority Area. Reasons for Exemption
The project meets the criteria set forth in CEQA Guidelines Section 15305 (Minor Alterations in Land Use Limitation) on the basis that this exemption allows for minor alterations in land use- limitations in areas with an average slope of less than 20 percent, which do not result in any changes in land use or density, including but not limited to minor lot line adjustments, side yard, and setback variances not resulting in the creation of any new parcel. The project has an average slope of 19.5 percent, which was calculated by dividing the rise of the project area (39 feet) by the run of the project area (200 feet) and multiplying by 100. The project would not change the land use or density, and would not create a new parcel, as the project proposes an easement vacation of a right-of-way and public improvements. Additionally, the project meets the criteria set forth in CEQA Section 15332 (In-fill Development Projects). The project is consistent with the applicable General Plan designation of Residential and all applicable general plan policies, as well as with applicable zoning designation of RM-2-5 and regulations. The proposed development occurs within city limits on a 0.11-acre site that does not exceed five acres and is substantially surrounded by urban uses, considering the site is within a residentially developed neighborhood. The project site consists of unimproved disturbed land, which has no value as habitat for endangered, rare, or threatened species. Approval of the project would not result in any significant effects relating to traffic, noise, air quality, or water quality as the project proposes a right-of-way vacation and public improvements which would comply with all local, state and federal regulations regarding traffic, noise, air quality and water quality. The site is within a developed urban neighborhood and can be adequately served by all required utilities and public services. Furthermore, the exceptions listed in 15300.2 would not apply. The site is not included on any list compiled pursuant to Government Code Section 65962.5 for hazardous waste sites.
