Document Description
Approval of an ordinance to establish a Harbor Construction Permit Policy that sets parameters for requiring a Harbor
Construction Permit to tenants and third parties performing significant construction work within the Harbor District. The Policy
will require tenants and third parties to provide a deposit of funds before initiating significant construction work. The deposit
amount will be based on the Estimated Construction Cost. The deposit funds would be released on completion of the project
and submission of required documentation. Tenants and third parties will be required to submit documents and/or drawings of
as-built conditions following completion of the project.

CEQA does not apply to the establishment, modification, structuring,
restructuring, or approval of rates, tolls, fares, or other charges by public agencies which the public agency finds are for the
purpose of obtaining funds for capital projects, necessary to maintain service within existing service areas. Adoption of the Harbor
Construction Permit Policy will provide Port staff the mechanism to ensure compliance and effectively monitor the construction
progress of projects through the use of a refundable deposit.
