Reasons for Exemption
Class 1 consists of the operation, repair, maintenance, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The project is located within existing County right of way along a paved roadway, within a residential neighborhood in an urbanized area. Subsection (c) includes existing streets, sidewalk, gutters, and similar facilities (including road grading for the purpose of public safety) and other alterations such as the addition of pedestrian crossings, street trees, and other similar alterations that do not create automobile lanes. The project would remove and replace existing curbs, gutters, and sidewalks resulting in no expansion of existing or former use and is therefore exempt from the provisions of CEQA.
