Reasons for Exemption
Section 15061(b)(3), excluding projects where “it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. The General Plan Amendment is consistent with a Certified FEIR (SCH 2022120088) and the expansion of the City’s Sphere of Influence boundary area does not by itself cause any modifications to the physical environment. Section 15164 - The General Plan Amendment would be similar to or less than the impacts addressed in the City’s General Plan 2045 Update Certified EIR (SCH 2022120088). No substantial changes would occur with respect to the General Plan Amendment to expand the City’s existing Sphere of Influence that will require major revisions of the Certified EIR. None of the conditions described in Public Resources Code Section 21166 and CEQA Guidelines Sections 15162 and 15163 requiring a Supplemental or Subsequent EIR would occur. Therefore, the General Plan Amendment would not create any potential adverse impacts beyond those evaluated in the Certified EIR. As such, the preparation of an Addendum is appropriate and fully complies with the requirements of Public Resources Code Section 21166 and CEQA Guidelines Sections 15162, 15163, and 15164.
