Reasons for Exemption
The project would qualify to be exempt from CEQA pursuant to Section 15269(c) (Emergency Projects) which allows for specific actions to prevent or mitigate an emergency. Since the immediate remediation of the emergency does not include a long-term project undertaken for the purpose of preventing or mitigating a situation having a low probability of occurrence, in the short-term the exemption was deemed to be appropriate. As a direct result of the coastal bluff failure City staff has determined that immediate action is necessary to prevent or mitigate loss of or damage to property. Not taking emergency action would likely endanger the property which would include the health, safety, and welfare of persons in or near the property. Therefore, immediate action is necessary to prevent impacts to human health and public safety.
