Reasons for Exemption
ZTA 2024-03/Maintenance of Animals Pursuant is covered by the Commonsense Exemption 15061(b)(3) that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Since this is a proposal to update Section 18.78.310 of the Inyo County Code pertaining to the Maintenance of Animals to provide clarity of nuisances potentially created by animals and provides setbacks for pens, cages, corrals etc. to property lines and buffers to streams. This will not cause a significant effect on the environment as these actions will result in less impact to surrounding properties and water courses.
