Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement EPIMS Notification No. EPIMS-NAP-52697-R3, pursuant to Section 1602 of the Fish and Game Code to Clover Flat Resource Recovery Park (Permittee) as represented by Mark Gingrich
The Project is limited to the restoration of an unnamed stream complex (Creek 2) totaling approximately 936 linear feet and 4.24 acres of restoration including re-establishing 2.96 acres of oak (Quercus sp.) woodland riparian habitat, 0.90 acres of oak woodland habitat, and 0.38 acres of naturalistic stream channel. This includes restoring previously burned mixed shrubland and oak woodland, and the decommissioning and removal of an access road detention basin, and one culvert. The culvert near DD-01 will be decommissioned. The Project partially offsets unauthorized impacts to stream and riparian habitat that resulted in stream filling, impairment of stream hydrologic and biological processes, and landfill leachate contamination into stream habitat of Creeks 2 and 1 based on CDFW’s Resources Impact Assessment, dated December 2019 and Natural Resources Damage Assessment, dated May 2020, and information provided by Permittee’s consultants.
Stream restoration will include the creation of a new realigned section of Creek 2 and a small tributary stream to the realigned section of Creek 2, which will also allow restored functions of upstream drainages. Creek 2 will then flow south through the approximate midline of the Project area before flowing into Creek 1.
The Project involves implementing a grading plan to recreate the original canyon, hillslopes, and stream corridor along the approximate alignment of the historical, pre-disturbance Creek 2. The channel and tributary morphologies to be built are designed to reflect the Project watershed setting and includes a series of boulder step pools, boulder cascades, and roughened channel reaches.
Currently, the inlet of the proposed Creek 2 channel is located at the confluence of two small drainages, where it flows through the Project site before daylighting at the southeast end of the restoration area into lower Creek 2 and then Creek 1. Grading will create a relatively flat 5 percent sloped reach in the middle of the Project site before steepening to the downstream end. The downstream end of Creek 2 connects to lower Creek 2, which continues eastward to its confluence into Creek 1. The newly realigned small tributary stream joins Creek 2 approximately 30 feet from the downstream end of the Project site. The new Creek 2 channel below the small tributary stream confluence will merge into the existing Creek 2 channel with a gradient of 50 percent.
The culvert near drainage ditch (DD)-01 will be decommissioned as part of Creek 2 Restoration construction in 2026. The culvert near DD02 will be removed by CFRRP staff after Creek 2 Restoration is complete and in conjunction with landfill grading activities and removal of the access road leading up to the Creek 2 Restoration project in 2026.
Revegetation at the site will be accomplished through initial removal of invasive non-native species biomass and placement of soils, then seeding and planting of native species appropriate to the area.
Access to the Project site for restoration activities will be from existing disturbed areas and roadways.
This on-site restoration provided by the Project will be credited towards the total restoration requirement for the unauthorized impacts described above.
