Document Description
The Department of Cannabis Control, pursuant to authority granted under Business and Professions Code, Section 26012, approved a Small Indoor commercial cannabis license submitted on 09/10/2024, by Grow 9 Organic, Inc. The Project will consist of the reconfiguration and rehabilitation of the interior of an existing building for the purpose of cannabis cultivation. Building 9 is part of a 42-acre commercial parcel (APN 0428-211-25-0000) zoned for commercial use, located in a developed area of Barstow with similar land uses, including retail, industrial, and other commercial activities. The 12,312-square-foot Building 9 represents approximately 3.7% of the total 330,000 square feet of building space across the 24-building complex. The site’s location along Interstate 15 makes it accessible but also places it in a region with constrained electrical infrastructure, necessitating careful energy management. The project involves 5,482 square feet of mature indoor cannabis canopy and 913 square feet of immature canopy which requires controlled environments with high-energy demands for lighting (e.g., high-pressure sodium or LED grow lights), heating, ventilation, and air conditioning (HVAC) systems, and other equipment. The operation adheres to strict state and local regulations governing cannabis cultivation, including licensing requirements from DCC and compliance with Barstow’s municipal ordinances.

Reasons for Exemption
The Department of Cannabis Control has determined that the project is a Class 32 Categorical Exemption project. Class 32 Categorical Exemptions consist of projects characterized as in-fill development meeting the conditions described in this section. (a) The project is consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning designation and regulations. (b) The proposed development occurs within city limits on a project site of no more than five acres substantially surrounded by urban uses. (c) The project site has no value as habitat for endangered, rare or threatened species. (d) Approval of the project would not result in any significant effects relating to traffic, noise, air quality, or water quality. (e) The site can be adequately served by all required utilities and public services. None of the exceptions to this exemption defined in Section 15300.2 apply.
