Reasons for Exemption
The Class 1 Categorical Exemption consists of the operation, repair, maintenance, permitting, leasing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The project consists of negligible or no expansion of former use involving the operation and maintenance of thirteen (13) existing pipelines and on Port of Long Beach and Port of Los Angeles jointly-owned property at the Alameda Corridor, former Union-Pacific San Pedro Branch, and Long Beach Lead railroad right of way. The Port has determined that none of the exceptions to the exemptions in the California Environmental Quality Act (CEQA) Guidelines Section 15300.2 foreclose the use of the categorical exemption CEQA Guidelines.

Reasons for Exemption
The statutory exemption as set forth in Section 21080.21 of the Public Resources Code consists of “…maintenance, repair, restoration, removal, or demolition of an existing pipeline as long as the project does not exceed one mile in length.” The project involves the operation and maintenance of thirteen (13) existing pipelines, with a combined length of 1,816 feet, or approximately 0.3 mile.
