Reasons for Exemption
The proposed Zone Change is to facilitate construction of a residence, gas station/convenience store, and appurtenant structures (“Project”). The Project is exempt from analysis under the California Environmental Quality Act (CEQA) pursuant to Class 3, 14 CCR § Section 15303, subsections (a) and (c). The proposed residence is exempt as a single-family residence pursuant to subsection (a). The proposed gas station and convenience store is exempt pursuant to subsection (c) as new commercial construction under 2,500 square feet not involving the use of significant amounts of hazardous substances. This subsection is applicable to the subject project because average gas stations are around 2,400 square feet and average convenience stores are just above 2,600 square feet, so the proposed gas station and convenience store will likely be around 2,500 square feet. Appurtenant structures such as garages are allowed under this subsection and are not included in area calculations to determine if the proposed project exceeds the 2,500 square foot limit.
