Reasons for Exemption
CEQA Guidelines 15064.5a.2, states, “a structure included in a local register is presumed to be historical or culturally significant unless the preponderance of evidence demonstrates otherwise.” In this case, the preponderance of evidence is the combination of the building inspection and architectural historian reports on file, which conclude that the structure has lost its historical or cultural significance, is unhabitable and dangerous. These two reports constitute the “preponderance of evidence” and so would be the basis in which the delisting and demolition or its removal could be exempt from CEQA. The Exemption is based on CEQA Guidelines 15061(b)(3).
