Document Description
The project consists of the division of an existing 0.71-acre parcel into three new parcels, one that will contain the existing single-family residence (Parcel 1), and two new parcels behind the existing home. Parcels will be between 0.23 to 0.29 acres in size. The sizes are the following: Parcel 1 at 0.29 acres, Parcel 2 at 0.23 acres, and Parcel 3 at 0.23 acres. Parcel 1 will be accessed off Orange Avenue, while Parcel 2 and 3 will be accessed by a new proposed private drive.
The project consists of the following entitlements:
1. A Tentative Parcel Map to divide a 0.71-acre parcel into three new lots in the Residential 5 (RD-5) zoning district.
2. A Special Development Permit to allow the proposed project to deviate from the following development standards:
• Minimum Interior Side Yard (Section 5.4.2.C, Table 5.7.C.): The minimum setback is five feet for one-story dwelling units. As proposed, the existing one-story single family dwelling unit on Parcel 1 is within the five-foot required interior side setback.
• Minimum Rear Yard (Section 5.4.2.C, Table 5.7.C.): Lot depths greater than 125’ require a 25’ setback. As proposed, the lot depth for Parcel 1 is greater than 125’, therefore the minimum setback is 25’. As a result, the existing single family dwelling unit on Parcel 1 is within the 25’ required rear setback.
• Front Yard for Residential Accessory Structures (Section 5.4.5.A, Table 5.10.A): The required setback is 20’. An existing carport on Parcel 1 is located within the required front yard setback for residential accessory structures.
• Interior Side and Rear Yard for Residential Accessory Structures (Section 5.4.5.A, Table 5.10.A): The required setback is 3’. An existing carport on Parcel 1 is located within the required interior side yard setback for residential accessory structures.
3. A Design Review to determine substantial compliance with the Sacramento County Countywide Design Guidelines (Design Guideline).

Section 15183 (PRC Section 21083.3), provides that projects which are consistent with the development density established by zoning, community plan, or general plan policies for which an environmental impact report (EIR) has been certified “shall not require additional environmental review, except as might be necessary to examine whether there are project-specific significant effects which are peculiar to the project or its site.” An EIR was prepared and certified by the Board of Supervisors for the Sacramento County General Plan Update (SCH# 2007082086) incorporated by reference and available at:
https://planning.saccounty.gov/PlansandProjectsIn-Progress/Pages/GeneralPlan.aspx.
The project is consistent with the development density and land use characteristics considered by the General Plan EIR and Zoning Code for the Low Density Single-Family Residential land use designation and RD-5 zoning districts. The project includes the division of a 0.71-acre parcel into three new lots, which would be consistent with the existing surrounding single-family uses. Future construction of the houses would comply with County Code Title 16 (Building and Construction) including land grading and erosion control (Chapter 16.44) and Title 22 (Land Development).
No new impacts peculiar to the project, or the parcel on which the project will be located, have been identified that would necessitate further environmental review beyond the impacts and issues already disclosed and analyzed in the General Plan Update EIR. No other special circumstances exist that would create a reasonable possibility that the project will have a significant adverse effect on the environment. Therefore, pursuant to CEQA Guidelines Section 15183, no further environmental review is required.
