Type, Section or Code
Class 1, CEQA Guidelines section 15301, Existing Facilities
Reasons for Exemption
CEQA Guidelines Section 15301 - Existing Facilities – Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features involving negligible or no expansion of existing or former use. The types of “existing facilities” itemized below are not intended to be all-inclusive of the types of projects which might fall within Class 1. The key consideration is whether the project involves negligible or no expansion of use. The project would consist of the purchase and operation of the existing parking structures/facility and would involve no expansion of the existing use.

Other
Type, Section or Code
Public Resources Code section 21065 and CEQA Guidelines section 15378(a)
Reasons for Exemption
Public Resources Code Section 21065 and CEQA Guidelines Section 15378(a) – Both sections define a “project” for CEQA purposes, The proposed purchase of the property and continued use of the property for parking are not a “project” subject to CEQA because there would be no alteration to the existing use of the property and therefore, no corresponding direct or reasonably foreseeable indirect physical changes in the environment.
Exempt Status
Other
Type, Section or Code
CEQA Guidelines section 15061(b)(3) - Common Sense Exemption
Reasons for Exemption
CEQA Guidelines Section 15061(b)(3) (common sense exemption) - The proposed purchase of the existing parking facility can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment because the SDCRAA would be continuing the existing use of the property for airport user parking.
