Reasons for Exemption
Class 3 applies to construction and location of limited numbers of new, small facilities or structures. The Project proposes a new commercial restaurant building not exceeding 10,000 square feet in an urbanized area where all necessary public services and facilities are available and the surrounding area is not environmentally
sensitive. Class 32 applies to in-fill development projects that meet the following conditions: (a) the Project is consistent with the applicable general plan designation and all applicable general plan policies as well as the applicable designation
and regulations; (b) the proposed development occurs on a project site of no more than five acres substantially surrounded by urban uses; (c) the Project has no value as a habitat for endangered, rare, or threatened species; (d) approval of the Project would not result in any significant effects relating to traffic, noise, air quality or water quality; and (e) the site can be adequately served by all required utilities and public services. As demonstrated in the technical analysis, which includes a Traffic Study, Vehicle Miles Traveled (VMT) Analysis, Noise and Vibration Analysis, Air Quality and Greenhouse Gas Analysis, and Preliminary Water Quality Management Plan, the Project would not have any significant effect related to traffic, noise, air quality, and water quality. As such, the Project meets both Class 3 and Class 32 conditions and is therefore categorically exempt.
