Reasons for Exemption
Project is exempt, consistent with the California Environmental Quality Act of 1970 (CEQA) and the State CEQA Guidelines, pursuant to Title 14, Cal. Code Regulations Class 3 Section 15303 pertaining to New Construction or Conversion of Small Structures, as it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. The intent of the project is to create new residential parcels and a remainder. The division will not result in any physical changes and will only create new property boundaries. No residence shall be built with the F-1 (Primary Flood Plain) Zone. No residence shall be built within the Conservation Easement, Recorded as Document No. 93-06495. No construction activity may encroach in the area which has been designated by the California Natural Diversity Database as an area that may be inhabited by Spiny-Sepaled Button-Celery. Therefore, the lead agency concludes that the proposed project fits under the exemption as the project is consistent with the Tulare County Zoning Ordinance and applicable General Plan Policies.
