Reasons for Exemption
The proposed project is exempt from the provisions of the California Environmental Quality Act ("CEQA") according to section 15301, Class 1 (Existing Facilities) of the CEQA Guidelines. Section 15301 provides an exemption for existing facilities where there is negligible expansion of an existing use and physical improvements are limited to minor interior or exterior modifications. In this instance, the project requires a conditional use permit to authorize both the on-site alcohol sales and consumption and outdoor dining in the public right-of-way. Physical alterations would consist of typical interior tenant improvements and minor alterations, like fencing and seating, within the right-of-way to provide for incidental outdoor dining consistent with CEQA Guidelines section 15301(c) There is, further, no evidence that the conditions listed in CEQA Guidelines Section 15300.2 precluding the use of an exemption exist. Therefore, section 15301 is an appropriate exemption.
