Reasons for Exemption
Section 15301 of the State CEQA Guidelines, titled “Existing Facilities,” reads as follows:
“Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The types of “existing facilities” itemized below are not intended to be all-inclusive of the types of projects that might fall within Class 1. The key consideration is whether the project involves negligible or no expansion of use.”
The proposed project includes the installation of a fuel cell system, which generates electricity from natural gas, and consists of enclosures, the energy servers and associated ancillary equipment, as well as the removal of 10 trees. This change constitutes a minor alteration to an existing facility and does not involve an expansion of the existing facility's industrial use. The intention of the fuel cell system is to serve the energy needs of the existing facility. Therefore, the project is exempt from CEQA pursuant to Section 15301 of the State CEQA Guidelines.
