Document Description
On August 8, 2025, the California Department of Fish and Wildlife (CDFW) issued this Restoration Management Permit (RMP) pursuant to section 1670 of the Fish and Game Code to the East Bay Regional Park District. This Project is designed to conserve, enhance, and restore sensitive coastal resources at Hayward Marsh. The Project’s primary restoration goals are to create and enhance wildlife habitat and to modify the site so that its habitats can accommodate sea level rise. To help achieve these goals, specific Project activities include levee improvements and breaches, removal of some existing nesting islands, enhancements to the remaining existing nesting islands, creation of new nesting islands, improvements to the channels within the Mouse Preserve to promote tidal flushing in the area, creation of breakwater features, and the creation of new upland transition zones that will offer additional habitat for tidal marsh-dependent species as sea levels rise. CDFW has determined that the Project is a Qualifying Restoration Project pursuant to section 1671(d)(1) of the Fish and Game Code, and the Project is expected to result in a substantial, cumulative benefit to native fish, wildlife, and their habitat. This notice is to advise that CDFW issued the above-described RMP on the date signed below.

The 320-acre Project is located within the Hayward Regional Shoreline, in the City of Hayward, adjacent to the San Francisco Bay shoreline and directly north of Highway 92. The Project is located in the County of Alameda, State of California; Latitude 37.629346 and Longitude -122.140079; and includes portions of San Francisco Bay, a segment of the San Francisco Bay Trail, a portion of Cogswell Marsh, Hayward Area Recreation District (HARD) Marsh, Hayward Marsh, and the Mouse Preserve.

CDFW has determined that the Project meets the qualifying criteria set forth in Section 21080.56, subdivisions (a) through (d), inclusive. CDFW’s determination is supported by (1) East Bay Regional Park District’s November 13, 2024, initial determination as lead agency that the Project meets the qualifying criteria set forth in Section 21080.56, subdivisions (a) through (d), inclusive; and (2) pursuant to Section 21080.56, subdivision (e), the CDFW Director’s November 26, 2024, concurrence with that East Bay Regional Park District’s determination, which is available at wildlife.ca.gov/Conservation/Cutting-Green-Tape/SERP/Concurrences.
