Document Description
The project consists of amendments to Sacramento County Code (SCC), Title 22, specifically Chapters 22.05-22.30, 22.40-22.45, 22.60, and 22.100-22.400, to incorporate recent changes in California state law, as well as changes to facilitate land division and development with Sacramento County. The proposed County Code Amendments are as follows: 1. Amendments to Sacramento County Code, Title 22 to: a. Identify the Subdivision Review committee as the hearing body for tentative subdivision maps, excluding "vesting" maps that are consistent with existing zoning, applicable Specific Plan, and/or General plan land use designation. b. Identify the Planning Commission as the hearing body for vesting tentative maps that are consistent with applicable zoning, Specific Plan, and/or General Plan designation. c. Identify the Director of the Department of Community Development (or designee) as the hearing authority for all map extensions of time. 2. Land Division Projects pursuant to SB 684 and SB 1123 The proposed revisions will amend a portion of the SCC so that the provisions of Title 22 are inapplicable to projects consistent with the guidelines of Sections 65852.28, 65913.4.5, and 66499.41 of the Government Code. 3. Administrative Amendments Update and clarify outdated language in Title 22, such as references to Public Works Department; and clarification of "board" and "director"). Update references to the Planning Director to County Engineer or County Surveyor where applicable. Correct minor grammatical errors and consistency in terminology. Update County processes, applications, and guides, including but not limited to the Zoning Code User Guide.

Reasons for Exemption
For Item #1 Amendments to Sacramento County Code, Title 22 CEQA Guidelines Section 15061 (b)(3). Land subdivision proposals subject to the provisions of Title 22 require an application for a Tentative Map, (discretionary project). A Tentative Map is considered a "Project", and the development proposal will be subject to the provisions of CEQA. The proposed project consists of lowering the hearing body authority for maps that meet specific criteria, and does not include any physical changes to the environment. Projects that were previously considered discretionary would remain discretionary, but with a different level of hearing authority. As such, it can be seen with certainty that there is no possibility that the proposed project may have a significant impact on the environment and is therefore exempt from the provisions of CEQA. For Item #2 Amendments to Sacramento County Code, Title 22 Ministerial exemption pursuant to Public Resources Code Section 21080. subdivision (b)(1). Recent legislation (SB 684, July 2024; and, SB 1123, July 2025) added sections 65852.28, 65913.4.5, and 66499.41 to the Government Code. Section 65858.28 subdivision (c)(1) states "a local agency shall ministerially consider, without discretionary review or a hearing, an application submitted to a local agency pursuant to this section." Because the revisions are required to be consistent with section 65852.28 of the Government Code, which is a state-mandated requirement, the revisions are ministerial and therefore not subject to CEQA pursuant to Public Resources Code section 21080, subdivision (b)(1 ). For Item #3 Administrative Amendments CEQA Guidelines Section 15061 (b)(3). The proposed project consists of minor administrative amendments and does not include any physical changes to the environment. These changes provide clarification on outdated references, grammatical errors, and inconsistencies in terminology. As such, it can be seen with certainty that there is no possibility that the proposed project may have a significant impact on the environment and is therefore exempt from the provisions of CEQA.
