Reasons for Exemption
The project is consistent with CEQA Guidelines Section 15332, which applies to projects characterized as infill development meeting the following conditions:
a. The project is consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning designation and regulations.
b. The proposed development occurs within city limits on a project site of no more than five acres substantially surrounded by urban uses.
c. The project site has no value as habitat for endangered, rare or threatened species.
d. Approval of the project would not result in any significant effects relating to traffic, noise, air quality, or water quality.
e. The site can be adequately served by all required utilities and public services.
The project is consistent with the General Plan designation of Commercial (C) and all applicable policies, as well as the zoning designation of Commercial Planned Development (CPD), and all required development standards outlined by the Lancaster Municipal Code (LMC). A Phase I Environmental Site Assessment of the site dated June 26, 2024 was conducted by Krazan & Associated, Inc. and identified no evidence of recognized environmental conditions of any kind.
The approximately 1.2-acre site has been developed with a commercial building since approximately 1990, formerly occupied by a movie theater. The proposed project involves construction and operation of a new car wash facility following anticipated demolition of the existing movie theater building. It is bordered by existing commercial development to the north, west, and south, and by SR-14 to the east. The development proposed would be substantially similar to existing and surrounding uses, and would not result in any significant effects relating to traffic, noise, air, or water quality. In addition, the site would continue to be served by all required utilities and public services.
As such, the site qualifies for a Class 32 Categorical Exemption.
