The project is exempt from the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15301, Class 1(a) (Existing Facilities), which consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use beyond that which existed at the time of the lead agency's determination. The site is developed and the Conditional Use Permit is to allow for the operator of the market to add distilled spirits to the existing sales of beer and wine. The Applicant is proposing no physical expansion of the building or the site.
