Document Description
On December 18, 2024, the City applied to LAFCO with a resolution of application to detach the Slack Street right-of-way and APN 052-082-028 (developed with recreational facilities for Cal Poly) from the City. The detachment includes only minor city boundary adjustments related to portions of Cal Poly property that currently fall within the City’s jurisdiction. These changes are intended to align the City boundary with the rest of the Cal Poly campus, which lies in unincorporated territory. The proposal does not result in any increased demand for municipal services, nor does it result in increased development potential. Existing services (such as water, sewer, and emergency fire protection) will continue to be provided to APN: 052-082-028 under the longstanding service agreements between the City and Cal Poly, dating back to 1993. Regarding Slack Street right-of-way, Cal Poly owns, maintains, and holds all liability obligations related to the curb, gutter, and sidewalk improvements; therefore, service in this area will remain unchanged. LAFCO is a Lead Agency under CEQA.

The detachment and SOI amendment consists of two areas of approximately 4.9-acres in size, generally located northeast of the City of San Luis Obispo (City). Area 1 is approximately 1.72-acres located entirely within the road right-of-way on Slack Street and is just south of APNs 073-341-042 & 043 (formerly APN 073-341-020). Area 2 is approximately 3.18-acres on Hathway Avenue (APN 052-082-028). The map and Legal Description can be found in Attachment A, Exhibit B, of the Commission’s July 17, 2025, staff report.

Pursuant to CEQA Guidelines Section15061(b)(3) the “General Rule” exemption is applicable because the action relates to the proposed modification of the city limit boundary to be consistent with the street abandonment on the northern Slack Street right-of-way and to correct City limit boundaries associated with APN 052-082-028 which is already developed and; Section 15320 Class 20, consisting of a change of organization of a local government agency (detachment from City) where the changes do not change the geographical area in which previously existing powers are exercised (services provided will remain the same). There are no circumstances under Section 15300.2 that would make the foregoing exemptions inapplicable. The proposed action to modify the geographic boundary of the city would not directly or indirectly result in a physical environmental change, nor result in increased development potential.
