Reasons for Exemption
Title 14 California Code of Regulations, Chapter 3, Article 18, CEOA Statutory Exemption Section 15273 states that CEOA does not apply to the establishment, modification, structuring, restructuring, or approval of rates, tolls, fares, or other charges by public agencies which the public agency finds are for the purposes of: (1) Meeting operating expenses, including employee wage rates and fringe benefits, (2) Purchasing or leasing supplies, equipment, or materials, (3) meeting financial reserve needs and requirements, and ( 4) Obtaining funds for capital proiects necessary to maintain service within existing services areas. The activity is an annual adjustment of the Flood Control Benefit Assessment rate by the Consumer Price Index. CEQA Statutory Exemption Section 15273 exempts the establishment, modification, structuring, restructuring, or approval of rates or other charges by public agencies.
