Document Description
The purpose of the Project is to construct a permanent classroom building to replace space provided in leased portables as well as to provide improved outdoor space for the school users. The Project includes: • Construction of a one-story 8,684 square-foot classroom building comprised of six (6) general classrooms each up to approximately 963 square feet and approximately 1,932 square feet of specialty instruction space such as a science, technology, engineering, and mathematics (STEM) lab; • Improvements to the outdoor space, including the installation of play equipment, seating areas, and approximately 7,250 square feet of landscaping; • Ground disturbance for the Project would include a maximum depth of soil disturbance up to five (5) feet below grade for over-excavation associated with construction of the proposed classroom building; and • Removal of three portables.

Reasons for Exemption
CEQA Guidelines Section 15302 (Class 2) permits the “replacement or reconstruction of existing structures and facilities where the new structure would be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced.” The Project has been examined in the context of Section 15302 and has been found consistent with these criteria. CEQA Guidelines Section 15314 (Class 14) permits the “minor additions to existing schools within existing school grounds where the addition does not increase original student capacity by more than 25% or ten classrooms, whichever is less. The addition of portable classrooms is included in this exemption.” The Project has also been examined in the context of Guidelines Section 15314 and has been found consistent with these criteria. Further, the application of Sections 15302 and 15314 of the Guidelines is not barred by any exceptions set forth in Section 15300.2. In addition, Section 15061(b) provides further guidance in the determination of whether an action is exempt from CEQA stating, “CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect the environment, the activity is not subject to CEQA.” The Project is minor in scope and involves the construction of a classroom building, installation of play equipment, seating areas, and landscaping within an existing school campus. The new structure would replace space that is currently leased in three existing portables on the site. The Project would not result in an increase in students or staff, or change the school hours of operation. Therefore, the Project would not result in a significant effect on the environment. Attachments to this Notice of Exemption provide additional detail in support of this finding.
