Document Description
The Department of Cannabis Control, pursuant to authority granted under Business and Profession Code, Division 10, Chapter 2, Section 26012, approved two commercial cannabis licenses consisting of one Specialty Cottage Outdoor license and one Specialty Outdoor license. : Approval of an Administrative Development Permit for the cultivation of cannabis located at 11044 Weeping Willow Way Nevada City, CA 95959 on two parcels under common ownership (APNs 004-400-051; 004-400- 033). The project is located on rural, 10.35-acre and 5.01-acre parcels in a General Agricultural zoning district. This approval is for 7,475 square feet of mixed light and outdoor canopy area. The mixed light canopy area will consist of two (2) 90' x 20' Ag Exempt High Tunnel Hoop Houses totaling 2,160 square feet. The outdoor canopy area will consist of two (2) 6' x 79' beds, one (1) 6' x 51' bed, and eleven (11) 82' x 4.5' beds, totaling in 5,313 square feet. There will be 1,878 square feet of support area that will include two (2) 8' x 40' storage containers for drying and harvesting consisting of 560 square feet, one (1) 20' x 50' Ag Exempt High Tunnel Hoop Houses used for immature plants, and three (3) 8' in diameter water tanks. The support areas and cultivation site will be accessed by a driveway off Weeping Willow Way. The site is served by an existing well for water. Full-time tasks on site will be performed by the owners/applicants, no off-site employees are proposed. There is no noise producing equipment proposed.

Reasons for Exemption
The Department of Cannabis Control has determined that the project is consistent with the local jurisdiction community plan and/or zoning designations. On May 14, 2019, Nevada County Resolution No. 19-199 certified a Program Environmental Impact Report (PEIR; SCH #2018082023) for the Nevada County Commercial Cannabis Cultivation Ordinance. On January 10, 2023, the Nevada County Board of Supervisors adopted an Addendum to the certified PEIR which analyzed potential impacts associated with amendments to the Nevada County Commercial Cannabis Cultivation Ordinance. CEQA mandates that the project is consistent with the development density established by existing zoning, community plan, or general plan policies for which an EIR was certified and shall not require additional environmental review, except as might be necessary to examine whether there are project-specific significant effects which are peculiar to the project or its site. The project activity fits within the parameters included in CEQA Guidelines Section 15183 and the activity does not require additional CEQA analysis.
