Document Description
Approval of an Administrative Development Permit for 7,902 square feet of mixed-light cultivation canopy area located within seventeen (17) agricultural exempt high tunnel hoop houses, 12,096 square feet of outdoor cultivation canopy located within fourteen (14) grow beds, and 50 square feet of support area located within one (1) 5-foot by 10-foot shed for agricultural chemical and pesticide storage. The site is accessed from an extension of the existing driveway and 25-foot-wide access road from Wolf Mountain Road. The site is served by an existing well for water and an existing septic system for sewage disposal. Full-time tasks on site will be performed by a resident of the parcel and zero (0) employees. The cannabis support structure and cultivation process will not have loud noise producing equipment. The cannabis cultivation areas will be located in a graded area that will require some vegetation removal along the extension to the residential driveway. The site will have no exterior lighting associated with the operation to produce light pollution. The project site is located in an area with no landmark oak groves or landmark oak trees, as described by the project biologist, Greg Matuzak in a technical memorandum dated March 30, 2021. The biological resources report also determined that although an intermittent waterway is located on the subject parcel, but not within any area of potential disturbance, therefore no Management Plan is required. There are no employees for the operation, so no additional vehicle trips are expected.

Reasons for Exemption
The Department of Cannabis Control has determined that the project is consistent with the local jurisdiction community plan and/or zoning designations. On May 14, 2019, Nevada County Resolution No. 19-199 certified a Program Environmental Impact Report (PEIR; SCH #2018082023) for the Nevada County Commercial Cannabis Cultivation Ordinance. On January 10, 2023, the Nevada County Board of Supervisors adopted an Addendum to the certified PEIR which analyzed potential impacts associated with amendments to the Nevada County Commercial Cannabis Cultivation Ordinance. CEQA mandates that the project is consistent with the development density established by existing zoning, community plan, or general plan policies for which an EIR was certified and shall not require additional environmental review, except as might be necessary to examine whether there are project-specific significant effects which are peculiar to the project or its site. The project activity fits within the parameters included in CEQA Guidelines Section 15183 and the activity does not require additional CEQA analysis.
