Reasons for Exemption
The proposed project was reviewed for potential exemptions and was found to satisfy the standards of Class 1 as specified within Article 19 Categorical Exemptions of the California Environmental Quality Act (CEQA) Guidelines. A Class 1 exemption consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination, including but not limited to: (c) Existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities (this includes road grading for the purpose of public safety), and other alterations such as the addition of bicycle facilities, including but not limited to bicycle parking, bicycle-share facilities and bicycle lanes, transit improvements such as bus lanes, pedestrian crossings, street trees, and other similar alterations that do not create additional automobile lanes.
The application meets the standards for Section 15301(c) in that the construction will involve minimal to no land alteration in an area that is already developed and the soil is disturbed. The project sites are located in the City’s Right-of-Way. None of the project sites are environmentally sensitive, and they will not result in significant effects to traffic, noise, air quality, or water quality with the construction of the new facilities. No significant adverse effects were identified during the evaluation process.
Therefore, the City of Whittier has determined that the project will not have a significant effect on the environment and a Notice of Exemption will be filed pursuant to Section 15062 of the CEQA Guidelines.
