Reasons for Exemption
These activities consist of the licensing of a revocable and non-exclusive right
to enter onto the Licensed Premises for the purpose of maintaining, operating, and using the bridge and ramp for approved uses. Approval of the Real Property License Agreement allows the continued use of the specified facilities consistent with existing practices. Construction of new, expanded, or modified facilities is not required
nor would it occur to implement the use of the associated License agreement.
This project qualifies for the California Environmental Quality Act (CEQA) Guidelines Class 1, Section 15301, “Existing Facilities”. “Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alterations of existing
public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination”.
