Document Description
To comply with California Government Code 51179, the adoption of the staff-recommended ordinance incorporates the Office of the State Fire Marshal's Fire Hazard Severity Zone Map. This results in the following effects: (1) New structures within the Very High Fire Hazard Severity Zone as identified in Cal Fire’s LRA Fire Hazard Severity Zone Map of March 2025 must adhere to CBC Chapter 7A; and (2) All existing and new structures in the Very High Fire Hazard Severity Zone are required to create a 100-foot defensible space perimeter from a structure.

Reasons for Exemption
Based on the whole record before it, pursuant to Section 15060(c)(2) of the California Environmental Quality Act (“CEQA”) Guidelines, the Ordinance will not result in a direct or reasonably foreseeable indirect physical change in the environment and therefore is not subject to the CEQA. Additionally, the Ordinance does not authorize construction, and in fact imposes greater restrictions on certain development in order to protect the public health, safety and general welfare, and therefore pursuant to CEQA Guidelines Section 15060(c)(3) the activity is not a “project” as defined in CEQA Guidelines Section 15378 because it has no potential for resulting in physical change to the environment, directly or indirectly.
