Reasons for Exemption
1. The project, Proposed Amendments to District Rule 217 - Additional Procedures for Issuing Operating Permits for Sources Subject to Title V of the Federal Clean Air Act (CEQA) Amendments of 1990, is exempt from CEQA pursuant to CEQA Guidelines Sections 15061(b)(3) – Common Sense Exemption. The District Governing Board does also hereby determine that the project is categorically exempt from CEQA pursuant to CEQA Guidelines Section 15308 – Actions by Regulatory Agencies for Protection of the Environment, and CEQA Guidelines Section 15321 – Enforcement Actions by Regulatory Agencies. These findings are based on the following facts: the amendments to Rule 217 make only administrative clarifications that will not require physical modifications, the amendments to Rule 217 are designed to further protect or enhance the environment, and the amendments to Rule 217 clarify enforcement rules and requirements.
