Reasons for Exemption
The project is Categorically Exempt from environmental review based on Section 15282(k), of the California Environmental Quality Act Guidelines, which exempts the installation of new pipeline or maintenance, repair, restoration, removal, or demolition of an existing pipeline as set forth in Section 21080.21 of the Public Resources Code, as long as the project does not exceed one mile in length. The project will repair existing Charter Communication facilities within the public right-of-way of 11th Street East and install approximately 500 linear feet of conduit within Palmdale Boulevard (State Route CA-138 and 11th Street East), under the terms of the franchise agreement the City has with Charter Communications. In addition, proposed construction does not include the use of hazardous substances as defined by the Palmdale Municipal Code.
