Document Description
The Alameda County Public Works Agency proposes to vacate a portion of the County’s right-of-way interest in the final 1,000 feet of Morrison Canyon Road, located in unincorporated Alameda County. This segment is currently maintained by the County for public roadway use under an existing easement. The proposed vacation would extinguish the County’s roadway easement while reserving a public utility and access easement to maintain service continuity for existing utilities. On June 16, 2025, the Alameda County Community Development Agency, under General Plan Conformance Resolution PLN-00076 (Resolution No. 25-06), determined that the proposed right-of-way vacation is consistent with the goals and policies of the East County Area Plan. Upon recordation of the Alameda County Board of Supervisors’ resolution approving the vacation, full property rights will revert to the underlying fee owner. At that point, the County's responsibility for maintenance and operation of this segment will cease. The vacation process was initiated through a formal application by the property owner and a petition submitted by members of the public. The property owner will assume future maintenance obligations and enter into appropriate easement and access agreements with the County. This proposed action will not authorize or facilitate any construction or development activities. The vacation, as proposed and conditioned, will not result in direct, indirect, or cumulative physical environmental impacts.

Reasons for Exemption
The activity is covered by Section 15061 (b)(3), the Common Sense exemption on the grounds that it can be seen with certainty that there is no possibility that the activities in question may have a significant effect on the environment, the activity is not subject to CEQA. The exemption is appropriate because the activity is a right of way being vacated by the County in favor of the adjacent owner. Since the activity itself is only a change in title, this activity will not create significant traffic, or vehicle miles traveled, nor will it create any significant effects regarding cumulative impacts, hazardous material, cultural or biological resources, and no more so than had it remained a County road. Therefore, the County as lead agency can say with certainty there is sufficient evidence, logically and by the mere nature of the activity, to conclude that there will not be a significant effect on the environment as defined under State CEQA 15061 (b)(3).
