Document Description
Lina Do has submitted a Minor Exception application, requesting to legalize a 98 square foot addition to the rear of an existing 946 square foot legal nonconforming single-family dwelling. The addition would bring the total square footage of the single-family dwelling to 1,044 square feet. The existing single-family dwelling is nonconforming due to the existing 4’-0” side yard setback (minimum 5’-0” side yard required) along the southern property line. To meet off-street parking requirements for the existing single-family dwelling, the applicant has proposed to enlarge the existing detached one-car garage, located at the rear of the property, to a two-car garage. . Additionally, the applicant is requesting a 20% exception (maximum 4’-0” permitted) to maintain and rehabilitate the existing 5’-0” front yard fence and gate. While 20% of 4’-0” equates to approximately 4’-10”, the Rosemead Municipal Code requires that fractional/decimal results of calculations be rounded to the next highest whole number when the fraction/decimal is 0.5 or more. Rehabilitation efforts consist of the repainting of the wrought iron fence. Moreover, the applicant has also proposed to include 480 square feet of new landscaping in the front yard. The project site is located at 7827 Hershey Street (APN: 5287-017-035) in the Light Multiple Residential (R-2) zone and consists of one parcel that totals approximately 5,600 square feet.

Reasons for Exemption
Section 15303 of the California Environmental Quality Act guidelines exempts projects consisting of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure. Accordingly, Minor Exception 24-05 is classified as a Class 3 Categorical Exemption, pursuant to Section 15303 of California Environmental Quality Act guidelines.
