Document Description
The Department of Cannabis Control, pursuant to authority granted under Business and Profession Code, Division 10, Chapter 2, Section 26012, approved a Medium Outdoor commercial cannabis license. The project is located on two (2) rural parcels of 67.57 and 39.75 acres in size in an Agricultural zoning district. A permitted residence exists on APN 060-300-020 and all cannabis cultivation activities are conducted on APN 060-290-016. This approval is for 39,549 square feet of mixed light and outdoor cultivation canopy area located within eight (8) 24-foot by 96-foot hoop houses each containing three (3) beds allowing for a total of 1,245-square feet of canopy area in each hoop house; eight (8)30-foot by 100-foot hoop houses each containing three (3) beds allowing for a total of 1,245-squarefeet of canopy area in each hoop house; (8) 24-foot by 96-foot hoop houses each containing three(3) beds allowing for a total of 1,245-square feet of canopy area in each Hoop House; and a total of 19,620-sqaure feet of outdoor canopy. This project will include 3,368 square feet of support area consisting of a 168 square foot area for the storage of tools, chemicals, and pesticides within hoophouse six, 150 square feet of irrigation water storage tanks, eight (8) 8-foot by 40-foot storage containers for curing, and two (2) 8-foot by 40-foot storage container for storage of chemicals and material holding as shown on the site plan. The site is accessed via a proposed private driveway off Pine Grove Reservoir Road. The site is served by an existing well for water and an existing septic system for sewage disposal. All full-time tasks on site will be performed by a resident of the parcel.

Reasons for Exemption
The Department of Cannabis Control has determined that the project is consistent with the local jurisdiction community plan and/or zoning designations. On May 14, 2019, Nevada County Resolution No. 19-199 certified a Program Environmental Impact Report (PEIR; SCH #2018082023) for the Nevada County Commercial Cannabis Cultivation Ordinance. On January 10, 2023, the Nevada County Board of Supervisors adopted an Addendum to the certified PEIR which analyzed potential impacts associated with amendments to the Nevada County Commercial Cannabis Cultivation Ordinance. CEQA mandates that the project is consistent with the development density established by existing zoning, community plan, or general plan policies for which an EIR was certified and shall not require additional environmental review, except as might be necessary to examine whether there are project-specific significant effects which are peculiar to the project or its site. The project activity fits within the parameters included in CEQA Guidelines Section 15183 and the activity does not require additional CEQA analysis.
