Document Description
An ordinance of the Town of Corte Madera adopting amendments to Title 18 of the Corte Madera Code to allow additional flexibility related to lot coverage and setbacks for uncovered decks 3-5 feet in height in the rear yard, limited to decks on Golden Hind Passage adjacent to the Bay and 2) increase in lot coverage by 2% for all residential parcels in the flood zone, medium density residential. Both of these modifications apply only to uncovered decks, landings or stairs attached to primary residences whose first floors are raised above base flood elevation.

Reasons for Exemption
The ordinance changes are very minor and will not change or increase the amount, type, or location of physical development in the town:
A. The Zoning Amendment will not result in a direct or reasonably foreseeable indirect physical change in the environment. CEQA Guidelines Section 15060(c)(2).
B. It can be seen with certainty that there is no possibility that this Zoning Amendment or its implementation of the Municipal Code amendments would have a significant effect on the environment and would not be detrimental to the public interest, health, safety, convenience, or welfare of the Town. CEQA Guidelines Section 15061(b)(3) (Common Sense Exemption).
C. No new development or construction is authorized by the Zoning Amendment and nothing in the Ordinance permits any expansion of use beyond the level of land uses already existing in the Town. To the extent that the Zoning Amendment may indirectly result in the alteration of existing structures, it is exempt from CEQA under CEQA Guidelines section 15301 (Existing Facilities).
D. To the extent that the Zoning Amendment may indirectly result in the construction of new structures, it is exempt from CEQA under CEQA Guidelines Section 15303 (New construction/conversion of small structures).
