Reasons for Exemption
The City reviewed the environmental impacts of the proposed Project pursuant to the California Environmental Quality Act (Public Resources Code §§ 21000, et seq. “CEQA”) and the regulations promulgated thereunder (14 Cal. Code of Regs. §§ 15000, et seq., the “CEQA Guidelines”). CEQA Guideline § 15303 (New Construction or Conversion of Small Structures) provides an exemption in urbanized areas, up to four such commercial buildings not exceeding 10,000 square feet in floor area on sites zoned for such use if not involving the use of significant amounts of hazardous substances where all necessary public services and facilities are available, and the surrounding area is not environmentally sensitive. This Project proposes the construction of a 3,780-square-foot restaurant building. Accordingly, no further environmental review is required.
