Document Description
The California Department of Fish and Wildlife has executed Lake and Streambed Alteration Agreement EPIMS Notification No. EPIMS-SCL-54656-R3, pursuant to Section 1602 of the Fish and Game Code to Jared Lewis/San Jose Water Company. The Project is limited to removing an existing elevated pipeline (above creek) and two (2) wooden trestles (one on each side of the bank) that spans the Los Gatos Creek and the riparian area above the creek. The pipeline would be removed via a crane staged within the developed area footprint, completely outside of the riparian/creek area. The wooden trestles are located above top of bank and will be cut at ground level by hand and removed by hand or aerially with the crane. Up to ten (10) mature riparian trees will be pruned to facilitate aerial access for the crane. The trees are rooted within the riparian zone and the canopy extends over the pipeline and Los Gatos Creek. Species include but are not limited to willows (~6"-10" DBH), coast live oak (~8"-20" DBH), sycamore (~8"-20" DBH) and non-native ornamental trees (~6"-10" DBH).

Reasons for Exemption
State CEQA Guidelines Section15301 provides for minor repairs/alterations to publicly or privately owned service facilities. This project is consistent with exemption outlined in this section. The project involves the removal of an existing 16-inch water pipeline and associated trestles. This work is in compliance with CEQA Class 1 (Existing Facilities) because the pipeline and trestles are existing infrastructure. The project will not expand the current use or involve significant construction beyond the existing footprint. Pruning of up to ten trees to facilitate crane access is considered a minor alteration and will not result in significant environmental impacts to the surrounding area.
