Document Description
The nature of the project is approval of the use of Transform CA, a pesticide, on cotton fields in the listed counties. The purpose is to provide an additional pesticide against Lygus infestation currently impacting these counties, and for which existing alternatives are ineffective to address the substantial pest pressure. The beneficiaries are cotton growers, who face significant economic harm with uncontrollable Lygus levels reducing yields, the employees who rely on a healthy cotton growing season for their livelihood, and others who rely on sufficient quantities of high quality California cotton.

Reasons for Exemption
An emergency registration pursuant to Food and Agr. Code section 12833 is considered an emergency project under CEQA because it can only be issued when there is an immediate need for an exemption from registration for situations involving an unpredictable emergency situation of an infestation and for which there are no available alternatives that are as effective at addressing the infestation. The emergency registration is only available while a full registration is pending but an emergency pest control problem arises before the regular registration can be completed. The current Lygus infestation in cotton is sudden and unexpected, presents clear and imminent danger, and demands immediate action to prevent loss of property. See Attachment.
