Document Description
The project area experienced 90-100% top-kill during the 2024 Park Fire emergency. All native perennial species in the area (except pine) aggressively resprout. The purpose of the project is to use herbicide to select for more-desired resprouting species and against less-desired resprouting species. (Species desirability is a function of each species' fire behavior & contribution to overall ecosystem biodiversity, and is captured in a detailed prescription.) The project is designed to result in more controllable fire behavior than no-action, which would benefit firefighters, WUI landowners, and prescribed fire practitioners. In conjunction with a suite of thinning and grazing actions that have long been underway under the Big Chico Creek Forest Health Restoration Project MND (SCH #2020040195), the applicant would now add implementation of a pest control recommendation developed by a licensed PCA and
forester (Mike Marvier, PCA # 117913 as well as RPF #2629; Rhianna Dutra, RPF #3098).

Reasons for Exemption
Herbicide application operations are subject to a comprehensive environmental review process established by the Department of Pesticide Regulation and administered by each county’s Agricultural Commissioner. The Musty Buck Herbicide Project consists solely of activities that are already, by law, regulated by this State program which is certified as a functional equivalent to CEQA pursuant to 21080.5 and 15251(i)(4). Therefore, no additional EIR, negative declaration, or initial study should be prepared for this project (21080.5(c)).
