Class 1 Existing Facilities (Section 15301)
Reasons for Exemption
Pursuant to the provisions of the California Environmental Quantality Act (CEQA Public Resources Code, Section 21083 et. Seq.), this project meets the criteria for a Categorical Exemption under Section 15301 (Class 1 – Existing Facilities) of the CEQA Guidelines in that the proposed project involves negligible or no expansion of use consistent with the criteria set forth in Section 15301. The removal of existing asphalt concrete, with the replacement of new rubberized asphalt concrete does alter existing public streets; additionally, the project does not add additional vehicular travel lanes; therefore qualifies for a Class 1 (Existing Facilities) exemption and no further environmental review is required pursuant to the California Environmental Quality Act (CEQA) Guidelines Section 15301.
