Document Description
The Department of Cannabis Control, pursuant to authority granted under Business and Profession Code, Division 10, Chapter 2, Section 26012, approved a Small Outdoor commercial cannabis license. The Project will consist of existing outdoor cannabis cultivation in Trinity County California. The project includes 9984 square feet of cannabis cultivation, with no use of artificial lighting in the canopy (mature plant) area. Water for the cultivation activity is provided by an onsite groundwater well, with a separate auxiliary well available for use if needed. A permitted septic system is used to treat wastewater. No expansion or construction is included in the project beyond what is already on site. The location is designated Agricultural and zoned Agricultural 10-acre min by Trinity County. An archaeological investigation in March of 2021 did not identify any cultural resources on site. Structures and buildings on site used to support the cultivation activity total 1280 square feet.

Reasons for Exemption
The Department of Cannabis Control has determined that the project is consistent with the local jurisdiction community plan and/or zoning designations. CEQA mandates that the project is consistent with the development density established by existing zoning, community plan, or general plan policies for which an EIR was certified and shall not require additional environmental review, except as might be necessary to examine whether there are project-specific significant effects which are peculiar to the project or its site. The project activity fits within the parameters included in CEQA Guidelines Section 15183 and the activity does not require additional CEQA analysis.
