Document Description
Lina Do has submitted a Minor Exception application, requesting to legalize a 98 square foot addition to the rear of an existing 946 square foot legal nonconforming single-family dwelling. The addition would bring the total square footage of the single-family dwelling to 1,044 square feet. The existing single-family dwelling is nonconforming due to the existing 4'-0” side yard setback (minimum 5'-0" side yard required) along the southern property line. To meet off-street parking requirements for the existing single-family dwelling, the applicant has proposed a new detached two-car garage, which will be located at the rear of the property. In addition, as part of this request, various site improvements to the front yard are proposed, which includes 480 square feet of new landscaping and a four-foot-high wrought iron fence and gate. The project site is located at 7827 Hershey Street (APN: 5287- 017-035) in the Light Multiple Residential (R-2) zone and consists of one parcel that totals approximately 5,600 square feet.

Reasons for Exemption
Section 15303 of the California Environmental Quality Act guidelines exempts projects consisting of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure. Accordingly, Minor Exception 24-05 is classified as a Class 3 Categorical Exemption, pursuant to Section 15303 of California Environmental Quality Act guidelines.
