Reasons for Exemption
Class Eleven (11) consists of construction, or placement of minor structures accessory to (appurtenant to) existing commercial, industrial, or institutional facilities, including on-premise signs. The project consists of one new identification monument sign with an electronic reader board on a site currently used as a community recreational facility. As the sign would be accessory to an existing institutional facility, the sign would fall under the on-premise sign category exempted under the 15311 exemption.
Section 15300.2 – Exceptions
Section 15300.2 of the CEQA Guidelines, Exceptions, provides conditions under which categorical exemptions are inapplicable. Review of the Project indicates that it will not violate any of the exceptions, as described in the following section.
1. For Classes 3, 4, 5, 6, and 11, will the project have an impact on an environmental resource of hazardous or critical concern where designated, precisely mapped, and officially adopted pursuant to law by federal, state, or local agencies?
The project parcel is located within an urbanized area consisting primarily of residentially zoned and developed properties. The project parcel is not located on or adjacent to an environmental resource of hazardous or critical concern as adopted pursuant to law by federal, state, or local agencies.
2. Will cumulative impacts be considerable because successive projects of the same type will occur at the same place over time?
The Project would not result in potentially significant impacts as the project proposal includes the construction of one on-premise monument sign where an existing non-illuminated monument sign already exists on a parcel developed with a community park facility. Therefore, the project as proposed would not result in cumulative impacts.
3. Is there a reasonable possibility that the activity will have a significant effect on the environment due to unusual circumstances?
The project includes one new monument sign. The proposed sign includes electronic lighting elements and would be located at the Vintage Park Drive entrance to Churchill Downs Community Park. It is expected that the sign would generate nighttime light. However, since the proposed sign would be located approximately 115 feet west of the closest residential structure, and fencing and landscaping is located between the sign and the residence, nighttime light generation is not expected to result in substantial glare impacts to adjacent properties.
4. Will the project result in damage to scenic resources, including but not limited to trees, historic buildings, rock outcroppings, or similar resources within a highway officially designated as a scenic highway?
The project is not located within the vicinity of a scenic highway and would not result in damage to scenic resources, including trees, historic buildings, rock outcroppings, or similar resources within a highway officially designated as a scenic highway.
5. Is the project located on a site which is included on any list compiled pursuant to Section 65962.5 of the Government Code?
The project site is not included on any list compiled pursuant to Section 65962.5 of the Government Code. Therefore, the Project will not have an impact related to being located on a hazardous waste site. Will the project cause a substantial adverse change in the significance of a historic resource?
The project site does not contain any historical resources.
