Implementation of this Plan will result in: (1) the removal of approximately 4,000 cubic yards of unauthorized fill placed within the Board's adopted floodway of the San Joaquin River; (2) restoration of the floodway to its previous natural condition; and (3) the relocation of removed material to its former location along an existing dirt access road located outside of the floodway boundary.

Reasons for Exemption
The project is exempt from CEQA under the Class 21, Enforcement Actions by Regulatory Agencies categorical exemption (CEQA California Code of Regulations, Title 14, Section 15321), because the activity consists of actions taken to enforce or revoke a lease, permit, license, certificate, or other entitlement for the issues, adopted, or prescribed by the regulatory agency or enforcement of law, general rule, standard, or objective, administered or adopted by the regulatory agency. In addition, the project is exempt from CEQA under the Class 1, Existing Facilities categorical exemption (CEQA California Code of Regulations, Title 14, Section 15301), because the activity consists of the operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use. No expansion of existing or former use will occur. The project is also exempt from CEQA under the Class 4, Minor Alterations to Land categorical exemption (CEQA California Code of Regulations, Title 14, Section 15304), because the activity consists of minor public or private alterations in the condition of land, water, and/or vegetation which do not involve removal of mature, scenic trees except for forestry and agricultural purposes. Finally, the project is exempt from CEQA under the Class 8, Actions by Regulatory Agencies for Protection of the Environment categorical exemption (CEQA California Code of Regulations, Title 14, Section 15304), because the activity consists of actions taken by regulatory agencies, as authorized by state or local ordinance, to assure the maintenance, restoration, enhancement, or protection of the environment where the regulatory process involves procedures for protection of the environment. Further, none of the exceptions to the exemptions in CEQA California Code of Regulations, Title 14, Section 15300.2 apply.
