Document Description
The Department of Cannabis Control, pursuant to authority granted under Business and Procession Code, Section 26012, approved a retailer commercial cannabis license submitted on December 12, 2024 by Shryne Madera LLC. The Project proposes a Medicinal and Adult-Use Commercial Cannabis retail location at 1105 Country Club Dr., Madera, CA. The 3,000 square foot dispensary would be located within a shopping center surrounded by other commercial retail uses. The dispensary would be open from 9am to 9pm daily within the site of a former Payless ShoeSource store.

Reasons for Exemption
The Department of Cannabis Control has determined that the project is a Class 1 and Class 32 Categorical Exemption project. Class 1 Categorical Exemptions consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alterations to existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. None of the exceptions to this exemption defined in Section 15300.2 apply.
Class 32 consists of projects characterized as in-fill development meeting the following conditions:
(a) The project is consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning designation and regulations.
(b) The proposed development occurs within city limits on a project site of no more than five acres substantially surrounded by urban uses.
(c) The project site has no value, as habitat for endangered, rare or threatened species.
(d) Approval of the project would not result in any significant effects relating to traffic, noise, air quality, or water quality.
(e) The site can be adequately served by all required utilities and public services.
