Reasons for Exemption
Pursuant to Section 6.03.06 of the Unified Development Code, all projects, as defined by the California Environmental Quality Act (CEQA), are required to undergo environmental review for compliance with CEQA and its Guidelines. The Grand Marketplace Project was reviewed in accordance with Title 14 of the California Code of Regulations (CEQA Guidelines) and has been determined to be exempt from further environmental review under a Class 32 Categorical Exemption (Section 15332 – Infill Development Projects). The environmental documentation, prepared by the applicant’s consultant, includes a Letter of Justification demonstrating that the project satisfies all criteria of the Class 32 exemption. Specifically, the project is consistent with the General Plan land use designation and zoning regulations, is located within the city limits on a site of less than five acres that is substantially surrounded by urban development, and does not have value as habitat for endangered, rare, or threatened species. The environmental review confirmed that the project will not result in any significant impacts related to traffic, noise, air quality, or water quality, and that the site is adequately served by all required utilities and public services. The project, consisting of the construction of two (2) commercial retail/service buildings totaling approximately 12,000 square feet within an existing developed shopping center located at 82227 Highway 111, is considered infill development under CEQA. The site is fully urbanized and has been previously disturbed, with no identified biological constraints. Construction-related noise and air emissions would remain below applicable thresholds and will comply with the City’s Municipal Code limitations on hours of operation. The project also adheres to applicable requirements related to storm water management, utility provision, and public safety. As such, no further environmental documentation is required unless there are substantial changes to the project scope or new information emerges that would necessitate additional environmental analysis under CEQA Guidelines Section 15162.
